Depends on whether or not it was full at one stage or only ever filled to half way. If it was full at one stage it means half has been emptied hence half empty, if it’s in the process of being filled or was only filled to half way it’d have to be half full.
Duh...What fucking glass are we talking about anyway? Who only fills your glass half full? Stingey bastards. I’m gonna go with half empty. That means I’ve already had half of it so I’m better off than those suckers saying "blah blah whine, it’s only half full so I’m gonna die before Po because he’s got twice as much water to survive on than me, blah whine blah blah!"
All in all, if it means I’ve got more I’m up for it.

I prefer to think of it in technical terms:
The lower half of the containment portion of the cup is completely occupied by water.
Anyway, when one sees a glass in that state, and no prior knowledge is given, it is impossible to make any assumptions as to how it reached that state, i.e. whether it was filled up all the way and poured out halfway(half empty) or just filled up halfway(half filled). However, since the common term for the cup being in the state previously described is being "half full," which implies the original act of filling which must have occured first, in neutral emotional circumstance I’d recommend using that. Too damn technical, and not what was originally intended, but it at least gives a reason for choosing one or the other in ordinary conversation.
